The Collapse of the 28-Article Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the tension sparked by the presentation of a new comprehensive peace framework for ending the war appeared – briefly – to have been defused. A Washington representative spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its retaliation: another massive barrage of rocket attacks on Kyiv.

The Rhythm of Negotiation and Warfare

The succession of opposing developments captured the grim essence of the outgoing year. By day, negotiation efforts are fought: positive announcements are delivered from different nations. Immense energy is allocated on managing particular approaches. By night, Moscow brutally reminds the world that, for them, conflict continues to be the main instrument for achieving "peace".

Nocturnal Warfare

As Russia's attack progressed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was revealed. Ukraine is capable of detecting rocket firings from across the border, a capacity provided through timely intelligence. From witness perspectives, defense planes that had been scrambled to intercept incoming cruise missiles flew past – modern combat jets provided to Ukraine by European allies.

Soon thereafter, Kyiv's air-defence systems thundered: several firings targeted at a incoming threat. This was a modern interception technology at work, presumably supplied through allied countries. Every deployment jolts you unexpectedly, rattling buildings. The brief panic quickly becomes resigned acknowledgment: maybe the hostile projectile won't hit its mark this time, sparing the city from devastation and another blackout.

Persistent Threats

Soon after, a large-caliber weapon opened up on a drone in the vicinity, part of a defensive team – probably imported technology. Unfortunately, the projectiles didn't strike the opposing UAV – it maintained course toward its destination.

Intermittently, this carried on until dawn. Kyiv awoke to the early updates: multiple fatalities, devastation and utility failures in numerous residences as a result of the nocturnal offensive. As typically, everyone still went about their day – experiencing conflict. But those 24 hours illustrated Ukraine's vital need on external assistance – a need that European nations are demonstrably unable to replace in the immediate future.

Failed Diplomacy

The 28-point plan from Washington sparked intense emotion, controversy and deep concern – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after earlier high-level meetings and multilateral gatherings.

Every new proposal from US leadership unfolds according to the consistent cycle: a political offensive against Ukraine, which Kyiv, with other European capitals, effectively counters. They manage the tension but never actually achieve victory. This pattern will, no doubt, endure.

Strategic Calculations

It is convenient to criticize particular leaders of repeatedly advocating Russian terms. But that does not seem to be the whole story. US administration functions according to a premise well known to seasoned negotiators: you cannot secure via talks what you have lost on the battlefield. The American government assumes that it is unfeasible to compel Moscow to abandon the areas that it already controls in Ukraine's southern or eastern regions.

The issue is that while accepting these circumstances, American administration does nothing to deter Moscow, through statements or actions, from thinking that the current condition will not evolve additionally in its benefit in the coming year.

Opposing Positions

Therefore, the Kremlin is convinced that duration works to their advantage – that Ukraine and its allies are approaching exhaustion. Their reason to agree to terms that does not give them the maximum possible gain is close to zero. There may be multiple initiatives to stop fighting, but they will continue as long as Russia's government remains highly assured in the result.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, progressively conceding people and territory but averting a total frontline collapse until conditions improve in its favour.

Present Conditions

Realistically, there are no genuine requirements for a ceasefire. Now, personal considerations are becoming relevant: personal goals to negotiate peace and achieve global acclaim, and the government's twin challenges – on one hand, not to distance important partners, and on the other, to mobilize citizens around the flag against any plan Kyiv finds unworkable, so that their priority does not move to domestic problems. And although their task will now be considerably more difficult after recent developments, it remains quite doubtful that this will modify their basic position.

These opposing factors are influencing discussions.

Summary and Prospects

It took a just a single week to kill the suggested clauses of the most recent proposal. Aggressive and erratic handling of the matter by US administration, opposition by Ukraine and the other European countries, along with soothing efforts of diplomats, and finally, current information leaks, all achieved their purpose.

While new initiatives based on established approaches are imminent, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are rooted in Kremlin requirements and show specific hesitation to modify developments, if they stand together and improve their protective measures at a much faster pace. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the predictable period, primarily depend on ongoing international assistance.
